NailThePick is a free, skill-based prediction game. There is no wagering, no stake, no deposit and no cash-equivalent balance. You never risk anything of value and you never pay to play or to improve your position.

We are not a sportsbook, not a betting exchange and not a fantasy sports operator offering paid entry. We are not affiliated with or endorsed by any league, club, player or broadcaster.

• You must be 18 or older and eligible under the Official Rules to hold an account.
• One account per person. You are responsible for everything that happens under your account and for keeping your credentials secure.
• Your handle and display name are visible to other players. Choose ones you are comfortable showing publicly.
• You may close your account at any time by writing to the address above.

You agree not to:

• Operate more than one account, or use another person's account.
• Submit predictions by any automated means, or interfere with the entry, locking or scoring systems.
• Attempt to access predictions that have not yet locked, or any data belonging to another user.
• Scrape, resell or redistribute the slate, the board or any other part of the service.

We may suspend or close accounts that breach these rules, and may void affected results.

Scoring follows the published method at nailthepick.com/rules, applied identically to every entrant. Contest outcomes and prizes are governed by the Official Rules, which take precedence over these terms where the two differ.

Scores come from third-party data providers. If a provider corrects a final score, we may rescore affected predictions and adjust standings.

We may change the scoring method, the rank thresholds, the sports covered or any other part of the game. Material changes to scoring take effect at the start of the next monthly contest period, never mid-period.

The NailThePick name, logo, interface and scoring method are owned by the Sponsor. Team names and abbreviations are used descriptively to identify matches and remain the property of their owners. We do not use league or club logos.

The service is provided “as is”. We do not warrant that it will be uninterrupted or error-free. We are not responsible for predictions that fail to reach us before a game locks for reasons outside our control, including network failures and device issues.

To the fullest extent permitted by law, the Sponsor’s total liability arising out of or relating to the service is limited to one hundred US dollars (USD 100). Because the service is free and nothing of value is risked, no claim may be based on lost points, lost rank or a missed prize.

You may stop using the service at any time. We may suspend or terminate access where these terms are breached, or where we are required to by law. Provisions that by their nature should survive termination do so.

These terms are governed by the laws of [governing state — to be confirmed], without regard to conflict of law principles.
